New Regulations for Investor & Working KITAS Applications With PMA

Indonesia Immigration has updated regulations concerning visas and stay permits. The full update is detailed below and the key aspects are as follows:


  • Those wanting to apply for Investor KITAS must have more than 10 billion shares in the company (before only 1 bill)

  • If an investor has less than 10 billion in shares, they can apply for working KITAS (would need to pay USD 1.200/ 12 months)

1. Background

In order to implement the delegation of several articles in Government Regulation Number 40 of 2023 concerning the Fourth Amendment to Government Regulation Number 31 of 2013 concerning Implementing Regulations of Law Number 6 of 2011 concerning Immigration, Minister of Law and Human Rights Regulation Number 22 of 2023 concerning Visas has been promulgated. and Residence Permit on August 24 2023.

The implementation of this regulation has an impact on changes to visa and residence permit services, including problems with adjusting service systems and business processes due to the transition from Minister of Law and Human Rights Regulation Number 29 of 2021 concerning Visas and Residence Permits to Minister of Law and Human Rights Regulation Number 22 of 2023 regarding Visas and Residence Permits.

In this regard, in order to ensure the smooth implementation of Residence Permit services during the transition period, it is necessary to stipulate a Circular Letter from the Director General of Immigration as a guideline for implementing applications and providing residence permit services.

2. Aims and objectives

a. The purpose of this circular letter is to provide legal certainty in the implementation of Stay Permit services during the transition period from Regulation of the Minister of Law and Human Rights Number 29 of 2021 concerning Visas and Stay Permits to Regulation of the Minister of Law and Human Rights Number 22 of 2023 concerning Visas and Residence Permit; And

b. The purpose of this circular is as a guideline for those implementing the duties and functions of the Stay Permit service in providing services to the community.

3. Scope
The scope of this Circular Letter is to confirm the implementation of residence permit services on transition period from Regulation of the Minister of Law and Human Rights Number 29 of 2021 concerning Visas and Residence Permits to Regulation of the Minister of Law and Human Rights Number 22 of 2023 concerning Visas and Residence Permits.

4. Basic
a. Law Number 25 of 2009 concerning Public Services;
b. Law Number 6 of 2011 concerning Immigration as has been amended several times,

most recently by Law Number 6 of 2023 concerning the Determination of Government Regulations in Lieu of Law Number 2 of 2022 concerning Job Creation into Law;

c. Government Regulation Number 31 of 2013 concerning Implementing Regulations of Law Number 6 of 2011 concerning Immigration as amended several times, most recently with Government Regulation Number 40 of 2023 concerning Fourth Amendment to Government Regulation Number 31 of 2013 concerning Implementing Regulations of Law Number 6 of 2013 2011 concerning Immigration;

d. Government Regulation Number 28 of 2019 concerning Types and Tariffs for Non-Tax State Revenues Applicable to the Ministry of Law and Human Rights;

e. Presidential Regulation of the Republic of Indonesia Number 18 of 2023 concerning the Ministry of Law and Human Rights;

f. Regulation of the Minister of Law and Human Rights Number 44 of 2015 concerning Procedures for Checking Entry and Exit Indonesian Territory at Immigration Checkpoints;

g. Regulation of the Minister of Law and Human Rights Number 28 of 2018 concerning Immigration Stamps as amended several times, most recently with Regulation of the Minister of Law and Human Rights Number 20 of 2022 concerning the Second Amendment to Regulation of the Minister of Law and Human Rights Number 28 of 2018 concerning Immigration Stamps ;

h. Minister of Law and Human Rights Regulation Number 41 of 2021 concerning Organization and Work Procedures of the Ministry of Law and Human Rights;

i. Regulation of the Minister of Finance Number 9/PMK.02/2022 concerning Types and Rates of Non-Tax State Revenue Urgent Needs for Immigration Services Applicable to the Ministry of Law and Human Rights;

k. Minister of Finance Regulation Number 82 of 2023 concerning Types and Tariffs for Types of Non-Tax State Revenue Urgent Needs for Golden Visa Services Applicable to the Ministry of Law and Human Rights.

5. Contents of the Circular Letter
a. To all those implementing the duties and functions of the residence permit service (executing staff to

structural officials) to:
1) Providing excellent service to the community;
2) Not committing corruption, collusion and nepotism;
3) Carry out supervision in stages; And
4) Coordinate and socialize with stakeholders and immigration guarantors regarding

this Circular Letter.
b. To the Head of the Immigration Division to:

1) Carry out guidance, control, supervision and evaluation of the implementation of immigration policies regarding Stay Permit services during the transition period from Regulation of the Minister of Law and Human Rights Number 29 of 2021 concerning Visas and Stay Permits to Regulation of the Minister of Law and Human Rights Number 22 of 2023 regarding Visas and Residence Permits; And

2) Report the results of evaluation of policy implementation periodically every 30 (thirty) days to the Director General of Immigration.

c. To the Head of the Immigration Office to:
1) Instruct structural and implementing officials in charge of immigration residence permits to

accept applications for residence permit services through the Immigration Information Management System (SIMKIM) V2 residence permit application originating from visas issued from the Molina application as long as the residence permit service in question is not yet available in the Molina application ;

2) Receive applications for residence permit services in the context of: a) Foreign Investors (PMA) with:

(1) Carrying out extensions, transfer of status, reporting, changes, granting and other services for Limited Stay Permits or Permanent Stay Permits for foreign investors abroadGolden Visawhich have been issued or have submitted applications before this circular comes into force with the requirements in accordance with the Regulation of the Minister of Law and Human Rights Number 29 of 2021 concerning Visas and Stay Permits based on the share value as regulated in the Investment Coordinating Board Regulation Number 4 of 2021 concerning Guidelines and Procedures for Risk-Based Business Licensing Services and Capital Investment Facilities until the deadline of 31 December 2024;

(2) Carrying out extensions, transfer of status, reporting, changes, granting and other services related to Limited Stay Permits or Permanent Stay Permits for foreign investors abroadGolden Visaafter 31 December 2024 in accordance with Minister of Law and Human Rights Regulation Number 22 of 2023 concerning Visas and Stay Permits;

(3) Implementing the granting of new Limited Stay Permits and changing the status of Visit Stay Permits to Limited Stay Permits in the context of foreign investors outsideGolden Visain accordance with Minister of Law and Human Rights Regulation Number 22 of 2023 concerning Visas and Stay Permits

c. Decree of the Minister of Law and Human Rights regarding ratification of the

establishment of a limited liability company legal entity; And d. Company statement for the last 2 (two) months.

b) Elderly foreign tourists with:
(1) Carrying out extensions, transfer of status, reporting, changes, granting and

other services related to Limited Stay Permits or Permanent Stay Permits for elderly foreign tourists with guarantors whose stay permits have been issued or applications have been submitted before this circular comes into force based on the requirements in accordance with the Regulation of the Minister of Law and Human Rights Number 27 of 2014 concerning Technical Procedures for Granting, Extension, Rejection, Cancellation and Expiration of Visit Stay Permits, Limited Stay Permits and Permanent Stay Permits as well as Exemptions from the Obligation to Have a Stay Permit or Regulations of the Minister of Law and Human Rights Human Number 22 of 2023 concerning Visas and Residence Permits while continuing the minimum age requirement of 55 years;

(2) Carry out the granting of new Limited Stay Permits and change the status of Visit Stay Permits to Limited Stay Permits for elderly foreign tourists with guarantors in accordance with the Regulation of the Minister of Law and Human Rights Number 22 of 2023 concerning Visas and Stay Permits since this circular came into force

(2) Carry out the granting of new Limited Stay Permits and change the status of Visit Stay Permits to Limited Stay Permits in the context of a second home in accordance with Minister of Law and Human Rights Regulation Number 22 of 2023 concerning Visas and Stay Permits since this circular came into force;

services granting/extending/transferring status/change/duplicate/reporting in the immigration residence permit application and replacing it with a statement and guarantee/information or data submitted by Foreign Person, Guarantor or Responsible Person:

6) Granting a stay permit period for an application for an immigration stay permit, without the need to adjust it to the validity period of the applicant's Travel Document;

7) Applications for granting, transferring status and extending a residence permit must be made when foreigners are in Indonesian territory;

8) Receive requests for changes to Travel Document data for Foreigners holding Limited Stay Permits or Permanent Stay Permits located outside the territory of Indonesia submitted electronically/on lineby Foreigners, Guarantor or Person in Charge;

9) Receive applications for re-entry permits for Foreigners holding Permanent Stay Permits who are outside the territory of Indonesia submitted electronically/on line by Foreigners, Guarantor or Person in Charge;

10) Carry out the issuance of Limited Stay Permit and Permanent Stay Permit cards in a new format if all infrastructure is available and there are further instructions from the Directorate General of Immigration;

11) Implement the types and rates of immigration stay permit services in accordance with:

a) Government Regulation Number 28 of 2019 concerning Types and Tariffs for Non-Tax State Revenues Applicable to the Ministry of Law and Human Rights;

b) Regulation of the Minister of Finance Number 9/PMK.02/2022 concerning Types and Rates of Non-Tax State Revenue for Urgent Needs for Immigration Services that Applies to the Ministry of Law and Human Rights; And

c) Regulation of the Minister of Finance Number 82 of 2023 concerning Types and Tariffs for Types of Non-Tax State Revenue Urgent Needs for Services Golden VisaApplicable to the Ministry of Law and Human Rights; as listed attached.

6. Conclusion
a. At the time this Circular Letter comes into effect, the Director General of Immigration's

Circular Letter Number IMI-0076.GR.01.01 of 2023 concerning Immigration Policy Regarding Electronic Arrival Visit Visa Services (Electronic Visa on Arrival/E-Voa), Visitor Visa on Arrival (Visa on Arrival), and Visa Free Visits to Support Sustainable Tourism during the PandemicCorona Virus Disease2019 is revoked and declared invalid; And

b. This circular letter comes into effect on the date of stipulation.

Thus, this circular letter is intended to attract attention and be implemented properly and responsibly. Thank you for your attention and cooperation.

Bali Visa Rules - What You Can and Can't Do - Tourist Visa, Investor KITAS, Working Kitas

Lately there has been a huge increase in people getting into trouble with the authorities in Bali for not using their Bali visas correctly. In many cases, this is through not knowing the terms of their visa, or being misinformed about actions that can be undertaken with a particular visa in Bali. Today we are detailing the regulations with regard to the main visas for tourists and ex-pats in Bali.

Bali Visa on Arrival - VOA


The visa on arrival is available to citizens of selected countries on arrival in Indonesia. You can also apply for it online before you arrive in Bali. Learn more about applying for the e-VOA for Bali here

This visa is initially valid for 3o days (including the date of arrival and departure) and can be extended once for an additional 30 days at a cost of IDR 850,000 to a maximum of 60 days. Find out about the VOA extension process in Bali here.

This visa is predominantly for tourists. When you have this visa, you cannot undertake any work activities in Bali. You can however have meetings with potential business partners in the future.

It is also not possible to change this visa to a different visa. So if you decided to stay longer than the maximum 60 days permitted with this visa, you would have to leave Indonesia and return with either a new VOA (for another stay of maximum 60 days) or a B211 offshore visa or KITAS for longer stays. These would require at least 3 working days to process the application with express service while you are outside of Indonesia.

B211 Offshore & Onshore Visa


This visa is also aimed at tourists and does not permit you to work while in Indonesia. You can however have meetings with potential business partners to scope out opportunities to start a business in Bali.

The maximum length of this visa is 6 months if you extend it every 60 days. More information on extending your Bali visa is available here.

It is possible to change this visa to another one, so you could get the onshore B211 after having the offshore B211. You can also change to a KITAS from the B211 Bali visa.

Investor KITAS


Many people got an investor visa during the last few years purely for the purpose of staying long term in Bali, rather than investing in Bali, and are now facing difficulties which we wrote about here.

Others are getting in trouble for working within their businesses, rather than taking on a pure investor role. To be safe from Bali authorities with an Investor KITAS you need to ensure you are doing the following:

What you must do if you have an Investor KITAS:



  • Investing in and managing a PT PMA business in Bali

  • Your PMA is undertaking activities in line with its business classification

  • Your PMA is submitting investment reports and paying taxes in line with regulations in Indonesia

  • You are NOT working in Bali


The Investor KITAS is for those investing in Bali, Indonesia. It does not permit you to do any hands-on work within your business.

What you can do with an Investor KITAS:



  • Manage the business

  • Attend meetings

  • Undertake staff training

  • Discuss large orders and sales with suppliers/buyers


What you cannot do with an Investor KITAS in Bali:



  • Do any marketing or advertising activities (these need to be done by local staff or a foreigner with a Working KITAS under your PMA who has the job classification of Marketing)

  • Cook at, clean, or tidy your business premises

  • Serve customers one-on-one

  • Be the person holding the camera doing photoshoots, videography etc


Currently, there is a big campaign in Bali to ensure visitors are using their visas correctly. IMMIGRATION CRACKDOWN ON TWO Year Investor KITAS

During the pandemic, we witnessed a dramatic increase in people getting an investor KITAS as a solution to staying long-term in Bali, with no intention to invest in Indonesia.

Agents typically offered the two-year investor KITAS for IDR 17,000,000 and did not inform their client that they had any obligations with this visa, for example, to invest or submit investment reports.

Often, many 'investors' have been grouped together in one PMA, sometimes more than 10 investors per company. In many cases, the 'investors' had no idea what kind of business their KITAS was sponsored by.

Risks of Investor KITAS


With so many people in one company, all it takes is one of the 'investors' to be caught using their visa incorrectly, and the whole company will get investigated. When it is clear the company has been set up fraudulently, the other 'investors' will get called into immigration and face fines and potentially deportation.

We have also heard of agents offering clients investor KITAS, but then not providing them with one, instead keeping them on the B211 onshore visa.

We are hearing reports that immigration officials are now actively looking into PMAs to check if they are doing business in Indonesia. They can do this easily by checking if those in charge of the company are submitting investment reports.

How To Stay Long-Term In Bali


You need to have the correct visa for your time in Bali, Indonesia. If you are here to stay long term and have work opportunities here, it is best to set up your own PMA which you can manage to ensure you are not at risk from unknown parties. The first time you do your Bali visa extension you will need to go to immigration to have your fingerprints and photograph taken. This applies to people with the following visas:

How long are tourist visas valid before I need to do a visa extension in Bali?


The Bali tourist visas are initially valid for:

  • Visa on Arrival (VOA) - 30 days

How long before expiry do I need to start the Bali visa extension process?


For those with B211a, B211b and VOA you will need to give us your passport and fee 7 days before your visa expires.

To extend a KITAS you will need to go for fingerprints and photos when the KITAS has already been applied for so it is late in the process and we will let you know with at least 1 week's notice when you need to go.

Do I have to got for fingerprints and photographs for every extension?


No. You only need to visit immigration so they can take your fingerprints and photograph the first time you extend your visa. For future extensions you just need to give your passport and the fee to our agents in the Visa Agency Bali Berawa office and we will process the extension entirely for you.

What is the price of a Bali tourist visa extension?


The extension for B211a & B211b onshore and offshore visas is 60 days and the price is IDR 2,750,000.

The extension for Visa on Arrival (VOA) is 30 days and the price is IDR 850,000.

How many extensions can I get?


For the B211 visas you can get the 60 day extension twice. For the VOA you can get the 30 day extension once.

When will I need to go to Bali immigration for fingerprinting?


We will tell you the appointment time to visit immigration. It is usually 7 days after you submit your passport to us for the extension. It will be at Jimbaran or Denpasar immigration office depending on your address in Bali, and we will inform you which office to go to. If you have plans to travel around Indonesia or the island of Bali please let us know so we can make the appointment on the appropriate day.

What are the steps for fingerprinting at Bali immigration?


Before your appointment, we will send you your billing by WhatsApp. Please bring this with you and take the following steps:

  1. Arrive at the Immigration office we told you of 10 minutes before your appointment time

  2. Go to the Customer Service counter and show your billing, you will get a queue number

  3. Wait until your number or your name is called by the officer and come to the fingerprint room

  4. Have your photo and fingerprints taken and give your queue number to the officer who will stamp and sign it

  5. Take a picture of your stamp and signed queue number and send it to us via WhatsApp

  6. When you have had your fingerprints taken, you can leave the Immigration office and we will text you when your visa extension is done.

How long does a Bali visa extension take?


From start to finish the process is usually around 2 weeks. 1 week prior to fingerprinting and then 1 week until you will get your passport back. The jobs you can have with this KITAS are Yoga Instructor, Marketing Manager or Marketing Advisor.


The 12-month KITAS will be under the business classification of SPORTS AND RECREATION EDUCATION SERVICES.

How to legally work as a Yoga Instructor in Bali



  • You can apply onshore or offshore to apply for this visa.

  • Processing the visa offshore takes 3 weeks to get e-Visa to travel to Bali, then 10 days to convert to KITAS when you are here in Bali.

  • Processing the visa onshore takes 1.5 - 2 months.

  • The price for offshore is IDR12,500,000. For onshore it is IDR17,500,000 (from B211.)

  • You will also need to pay 12 months' tax (USD 1200) when you apply for the Yoga Instructor KITAS and if you apply offshore there is an additional visa fee (USD 150.)


To apply for your Yoga Instructor KITAS, we need the following:


For onshore & offshore applications

  • Passport cover and ID page (Validity should be at least 18 months for the 12-month application)

  • Copy colour of Graduated Certificate (Diploma)

  • Copy colour of Reference Letter (from an old employer)

  • Passport style photo size 4 × 6, respectively 2 pieces (red background)

  • Email address and phone number

  • Vaccine Certificate with full doses

  • Copy colour of health or travel Insurance Policy

  • Statement letter of willingness to comply with the health protocols in Indonesia (we will provide a draft for you to sign)

  • Recent bank statement with minimum funds of approximately USD 2,000


Onshore applicants also require:

  • eVisa, payment receipt and Last Visa Stamp B211 (min. valid for 45 days)

  • Statement letter from old sponsor

  • Documents from old sponsor

Working visa for the Arts in Bali, Indonesia


Terms, Timings & Price


The maximum duration for an Impresariat KITAS is 6 months. To process the visa takes 4 weeks with our standard service and 2 weeks with our express service.

The KITAS is only available onshore and the price is IDR12,500,000 for our standard 4-week service. You will also need to pay the visa fee (USD 150) and 6 months' tax (USD 600) upfront. If you have a company that will sponsor your visa the price is IDR 10,500,000. For both options, if you would like our 2-week express service, this will cost an additional IDR 3,000,000.

If you are currently outside of Indonesia you will need to enter Indonesia with the B211 offshore visa. We can then start the process of applying for your Impresariat KITAS.

How to get a visa to work in the Arts in Bali


To apply for your Impresariat KITAS, we need the following:

  • Passport cover and ID page (Validity should be at least 12 months for the 6 month application)

  • Recent bank statement with minimum funds of approximately USD 2000

  • Passport-sized photos 4 cm x 6 cm, taken with formal attire using a white background (digital copies preferred)

  • A valid Health or travel insurance

  • Evidence it had received doses of the vaccine Covid 19 completely (or letter from Dr)

  • Last visa stamp

  • Statement letter of willingness to comply with the health protocols in Indonesia
